EB-1 PREFERENCE CATEGORY FOR FY2024 FULLY EXHAUSTED
As was expected, the Department of State announced on August 27, 2024 that no further EB-1 visas/green cards will be issued for the remainder of this fiscal year (ending on September 30, 2024) as all numbers in the EB-1 preference category for FY2024 have been utilized.
The DOS Liaison Committee [in its briefing] on the September 2024 Visa Bulletin had informed that due to high demand for visa numbers in the employment-based categories, it might be necessary “to immediately make [a] preference category ‘unavailable,’ and no further requests for numbers would be honored.” This further gave an indication that the EB-2 and EB-4 categories may become unavailable in the near future.
This will not affect those whose priority dates are current under the Visa Bulletin and USCIS policy in effect for the respective month.
