Admiralty & Maritime Law

Our Firm can assist clients that have been injured while in, on or around various bodies of water such as New York, whether while on a boat or in the harbor. Admiralty and Maritime law extensively deals with the application of law to events that occur on oceans, large lakes or rivers that can be used for commercial shipping.

These waters are divided into territorial waters and the high seas. Territorial waters are close to land while the high seas are those waters that are further away from land. Injuries can occur either in or around these bodies of water that invoke application of Admiralty and Maritime Law. Secondly, The Jones Act is a federal law that protects employees who are involved in workplace accidents. Under the Jones Act an employee has a right to a "safe place to work". The Jones Act is a fault based statute that means that an employee can collect damages if an employer is at fault. This fault can take many forms including the improper or unsafe acts of co-employees, an unsafe workplace, or unsafe or improper instructions. It is often easy to show that injury could have been avoided if employer acted in a safer manner.

Jones Act mandates that an employer must properly train employees, properly supervise their work activities, and provide enough employees to perform the jobs to which you are assigned. Employers are usually found to perform a job without sufficient employees as these employers very often simply perform the job with the crew members that are available at that time thereby indication to Judge or Jury that safe working conditions were not provided to employees thereby creating a cause of action in favor of injured employees. Coast Guard rules do find an application under the Jones Act. This empowers the Coast Gurad to investigate serious injuries which occur under the Jones Act. Coast Guard regulations mandate keeping the vessel safe without any dangerous trip or slip hazards aboard the vessel. All walkways must be properly marked under Coast Guard regulations.
